Former Liberty County Assistant DA faces charge in hit-and-run, according to crash report


MONTGOMERY COUNTY, Texas (KTRK) — A now-former Liberty County Assistant District Attorney found himself on the other side of the law, as he’s charged in an alleged hit-and-run in Montgomery County.

A DPS crash report showed it occurred in late October in Porter and involved Mark A. Boemio, who was a prosecutor at the time of the crash.

The report said Boemio, identified as the driver of Unit One in the report, fled the scene and is being charged with failing to stop and give information.

Kyle and Emily Hicks said they were in the vehicle that was hit, along with their children. The Hicks said that was the only vehicle they had.

“We were driving home and, like, just going normal, and somebody came and smashed us, like smashed into the passenger side of our vehicle,” Emily said.

Emily said she saw Boemio get out of the vehicle after the crash, but she said he wouldn’t respond to her when she asked if he was okay. She said she notified first responders that he might need help.

“All of a sudden, nobody could find him,” Emily said.

Liberty County District Attorney Jennifer Bergman issued a statement saying, “As of last week, Mr. Boemio is no longer employed with this office. This is an unfortunate situation, and while we are disappointed to learn of these allegations, we trust that the judicial process will proceed appropriately in Montgomery County.”

The family said they only recently found out that Boemio worked at the DA’s office.

“All those inconveniences were caused even before we knew who he was,” Emily said. “Then finding out who he is is kind of crazy, considering he knows the law. He absolutely knows the law.”

The family said all of this happened at the worst time for them after one of their daughters was recently diagnosed with Crohn’s Disease.

“It’s really crazy,” Emily said. “Didn’t think we wouldn’t be able to get to these appointments we’ve been trying to schedule and deal with for months and months.”

The Hicks said they left the crash with bumps and bruises that have healed with time. Yet, they described continuing to feel the lasting impacts of what happened as they navigate their day-to-day lives without a vehicle.

“It’s hard to plan, and it feels like we’re standing still at this moment,” Kyle said. “We have to deal with all these problems that we didn’t ask for.”

Boemio’s name has not shown up on the Montgomery County Jail roster yet. ABC13 reached out to him for comment, and we are waiting to hear back.
