Judge orders Galleria Food Truck Park on Chimney Rock in west Houston to close after nuisance lawsuit


HOUSTON, Texas (KTRK) — A popular west Houston food truck park has been closed after a series of complaints about noise and crime.

Councilman Edward Pollard had threatened to have the Galleria Food Truck Park on Chimney Rock near Westheimer shut down following a Sept. 12 shooting on the street beside the truck park.

“It’s not targeting,” Pollard said at the time. “It is accountability.”

Wednesday, the city filed a lawsuit against the truck park’s owners calling the property a “nuisance” and citing shootings, a robbery, and health code violations.

Thursday afternoon, a judge issued a temporary injunction ordering the truck park to close.

While the order is temporary, both property owners listed in the lawsuit tell Eyewitness News they don’t plan to fight the city and that the food trucks will relocate.

“It feels really weird seeing every single truck closed and nobody here,” Enrique Martinez, who operated a food truck in the park with his father, said.

The two have since moved their truck to a new location two miles further down Westheimer.

Homeowners in the nearby Villa De Fiori community welcomed news of the judge’s order.

“I’m not used to the wheels of justice turning so fast,” Jack Downer said.

“That tells me that the problems that we were seeing were legitimate,” Bartt Shelton said.

Shelton and Downer had long complained about loud music, revving car engines, and public urination, which they claimed the food trucks attracted.

“Food truck parks are mobile,” Kyle Mani, president of the Villa De Fiori HOA, said. “They can always find another nice spot to go to. We have houses. We are not mobile.”

Downer is predicting swift changes with the departure of the food trucks.

“It’ll definitely be a much quieter evening for the residents of our community. Much quieter,” he said.

But Martinez and other food truck operators have serious doubts about that.

“I mean, there’s a strip club over there, you know, that tends to attract a lot of bad people, but I mean, if this is what they believe is gonna fix things, I mean, let them have it, I guess,” Martinez said.

“We sad but, you know, it is what it is,” food truck owner Giovanni Lucas said.

A hearing on the city’s lawsuit is set for Oct. 3.
